Terms of Service

1. License Grant

Upon purchase of MusicLaunch (one-time fee; $99 launch price, $150 after launch), we grant you a non-exclusive, non-transferable, revocable license to install and use the application for your own use on one Mac at a time. This license is for the software as-is at the time of purchase and includes any free updates we choose to provide within the purchased major version (1.x). Major new versions, if released, may be offered as optional paid upgrades.

Moving to a new Mac. You may move your license to a different Mac of your own at any time: deactivate it on the old Mac (in the app under Settings → License, or at musiclaunchapp.com/license if you no longer have access to that Mac), then activate it on the new one. Because your data is stored only on your Mac (see Section 4), it does not move automatically — use the app’s backup export and import to bring it with you. “Non-transferable” means you may not sell, give, or lend your license to another person.

You may not sublicense, resell, distribute, reverse-engineer, decompile, or create derivative works from the application.

Age. You must be 18 or older to buy or use MusicLaunch, including its AI features. By buying or activating MusicLaunch, you confirm that you are.

2. AI Subscription Services

MusicLaunch offers optional AI-powered features through paid subscription tiers, the Backstage Pass, VIP and All Access plans (subscriptions to MusicLaunch’s AI assistants, which the app calls “your team”):

• Backstage Pass — $15/month (up to 2 artist profiles)
• VIP — $35/month (up to 5 artist profiles, 3X AI usage)
• All Access — $150/month (up to 20 artist profiles, 10X AI usage)

Each tier includes a monthly AI usage allowance, measured in tokens: Backstage Pass 1,000,000 tokens, VIP 3,000,000 tokens, and All Access 10,000,000 tokens per month. Usage resets on the 1st of each month, and upgrading raises your limit immediately. Actual output per request varies, so these allowances do not correspond to a fixed number of generations, chats, or images.

Subscriptions are billed monthly through our payment processor, Stripe. You can change your plan or cancel at any time yourself, in the app under Settings → License or at musiclaunchapp.com/license. An upgrade takes effect immediately: you get the higher plan's AI usage right away and are charged only the price difference for the rest of the billing period. A downgrade also takes effect immediately, and the difference is credited toward your future bills. Cancellation takes effect at the end of the current billing period, and you keep AI access until then. If the application purchase is refunded, any AI subscription on that license is cancelled at the same time. No partial refunds are provided for unused portions of a billing cycle.

We reserve the right to modify subscription pricing with 30 days' notice. Existing subscribers will be notified before any price changes take effect.

3. Free Trial

The desktop application is not offered on a free trial — it requires a one-time license purchase to use. AI features are included for 30 days starting when you first activate the app (moving your license to a different Mac does not restart this period); continued access to AI features after that period requires an active AI subscription. Purchases are covered by our 30-day money-back guarantee, described in the Refund Policy below.

4. Your Data

MusicLaunch is a desktop-first application. Your campaign data, contacts, budgets, and other project information are stored locally on your computer. Your data is not synced between computers; if you move to a new Mac, use the app’s backup tools (Settings → Data Backup) to bring it with you.

Backing up your data. We do not keep a copy of your app data, and we cannot recover it if your Mac is lost, stolen, damaged or erased, or if your data is deleted or corrupted. We strongly recommend that you use Apple’s Time Machine and also keep a recent copy of your MusicLaunch data somewhere other than your Mac, such as an external drive or, if you are comfortable storing your data there, a cloud storage service. Copies you keep with a cloud storage service are governed by that service’s own terms. The app’s backup tools help you make copies, but they cannot guarantee that every file is copied or uploaded, so check that your backups finish and keep them somewhere you trust. You are responsible for backing up your own data.

We do not collect or store your local application data. If you use AI features, your prompts — together with the relevant portions of your locally stored data needed to fulfill the request (for example, the campaign, contact, budget, or gear information the assistant is helping you with) — pass through our server (musiclaunchapp.com) to our AI provider, Anthropic, for processing. Our server checks your license and keeps a usage record (which feature, when, and how many tokens), but does not store what you asked or what the AI answered. This information is processed to generate your response and is not used by us or, per its API terms, by Anthropic to train AI models.

Connected platforms & YouTube. If you connect third-party accounts (such as YouTube, Instagram, Facebook, TikTok, or Spotify), your use of those platforms remains governed by their own terms. In particular, MusicLaunch uses YouTube API Services — by using MusicLaunch’s YouTube features you also agree to be bound by the YouTube Terms of Service, and Google’s handling of your data is described in the Google Privacy Policy. You can revoke MusicLaunch’s access to your Google account at any time via your Google security settings.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to circumvent license validation or usage limits
• Share your license key or subscription credentials with others
• Use AI features to generate content that is harmful, abusive, or violates third-party rights
• Interfere with or disrupt the integrity of the Service
• Use automated means to abuse AI usage limits or API endpoints

6. Intellectual Property

The MusicLaunch application, website, branding, and all associated content are the intellectual property of MusicLaunch and are protected by applicable copyright and trademark laws.

Content you create using MusicLaunch (campaigns, plans, notes, etc.) belongs to you. AI-generated suggestions are provided for your use and you retain rights to any content you create based on those suggestions.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

AI-generated content is provided as suggestions only. We do not guarantee the accuracy, completeness, or suitability of AI outputs. You are responsible for reviewing and verifying any AI-generated content before acting on it.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUSICLAUNCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Refund Policy

We offer a 30-day money-back guarantee on the one-time application purchase. If you are not satisfied with MusicLaunch, contact us within 30 days of purchase for a full refund. Subscription refunds are handled on a case-by-case basis.

10. Termination

We reserve the right to suspend or terminate your access to the Service if you violate these Terms. Upon termination, your license to use the application is revoked, but your locally stored data remains on your device.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
