Terms of Service

1. License Grant

Upon purchase of MusicLaunch ($150 one-time fee), we grant you a non-exclusive, non-transferable, revocable license to install and use the application on your personal device(s) for your own use. This license is for the software as-is at the time of purchase and includes any free updates we choose to provide.

You may not sublicense, resell, distribute, reverse-engineer, decompile, or create derivative works from the application.

2. AI Subscription Services

MusicLaunch offers optional AI-powered features through paid subscription tiers:

• AI Artist — $20/month (1 artist profile)
• AI Pro — $50/month (up to 5 artist profiles, 3X AI usage)
• AI Enterprise — $200/month (up to 20 artist profiles, 10X AI usage)

Subscriptions are billed monthly through our payment processor. You may cancel at any time; cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing cycle.

We reserve the right to modify subscription pricing with 30 days' notice. Existing subscribers will be notified before any price changes take effect.

3. Free Trial

New users receive a 30-day free trial of AI Artist-tier features. No payment information is required to start the trial. At the end of the trial period, AI features will revert to default limits unless you subscribe to a paid plan.

4. Your Data

MusicLaunch is a desktop-first application. Your campaign data, contacts, budgets, and other project information are stored locally on your computer. You are responsible for backing up your own data.

We do not access, collect, or store your local application data. If you use AI features, your prompts are sent to our AI service provider for processing but are not used to train AI models.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to circumvent license validation or usage limits
• Share your license key or subscription credentials with others
• Use AI features to generate content that is harmful, abusive, or violates third-party rights
• Interfere with or disrupt the integrity of the Service
• Use automated means to abuse AI usage limits or API endpoints

6. Intellectual Property

The MusicLaunch application, website, branding, and all associated content are the intellectual property of MusicLaunch and are protected by applicable copyright and trademark laws.

Content you create using MusicLaunch (campaigns, plans, notes, etc.) belongs to you. AI-generated suggestions are provided for your use and you retain rights to any content you create based on those suggestions.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AI-generated content is provided as suggestions only. We do not guarantee the accuracy, completeness, or suitability of AI outputs. You are responsible for reviewing and verifying any AI-generated content before acting on it.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUSICLAUNCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Refund Policy

We offer a 30-day money-back guarantee on the one-time application purchase. If you are not satisfied with MusicLaunch, contact us within 30 days of purchase for a full refund. Subscription refunds are handled on a case-by-case basis.

10. Termination

We reserve the right to suspend or terminate your access to the Service if you violate these Terms. Upon termination, your license to use the application is revoked, but your locally stored data remains on your device.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
